DPHHS releases changes to Montana’s medical marijuana rules

BILLINGS – Montana’s medical marijuana industry continues to evolve with new changes to its rules outlined recently by the Department of Public Health and Human Services. In the latest changes, the state added mandatory testing again in place of randomized testing. Providers said they liked the revisions, and some called it a “great day for the industry.” Others expressed the need for more change. “It’s expensive. Random testing done by an inspection is a much better way to catch pesticides,” said Elizabeth Pincolini, owner of Alternative Wellness Montana. License costs for providers with 11 to 49 patients were lowered to $2,500. Providers with under 11 patients must pay $1,000 while providers over 49 must spend $5,000. “The revised provider’s fees for middle-sized providers is good and helps them stay in business,” Pincolini said. The Honolulu Police Department is ordering legal cannabis patients to “voluntarily surrender” any guns they own because pot is still considered an illegal drug under federal law. The initiative continues three months after Hawaii’s first medical marijuana dispensary opened for business. “Your medical marijuana use disqualifies you from ownership of firearms and ammunition,” Honolulu police Chief Susan Ballard wrote in a Nov. 13 letter to one medical marijuana card holder. “If you currently own or have any firearms, you have 30 days upon receipt of this letter to voluntarily surrender your firearms, permit, and ammunition to the Honolulu Police Department or otherwise transfer ownership.” In the letter, Ballard cites Hawaii Revised Statutes, Section 134-7 (a) as the reason for the move. Proposed sites for the up to 24,000 square foot facilities are sprinkled around the state, with 7 in northeast Ohio, 2 more along Lake Erie, 3 in southwest Ohio, and two in the southeast. The system to grow medical marijuana is expected to launch by next September. One of the applicants who lost out on a large grower license is threatening a legal challenge to the final selection. Cincinnati sports agent Jay Gould, CEO of CannAscendOhio and an early backer of legalized medical marijuana in Ohio, charges the state selection process was unfair. Large-scale growers paid $20,000 to apply, and one submitted two possible which will be decided in upcoming weeks. They will pay $180,000 in initial licensing fees and $200,000 a year thereafter.
